Notice of Understanding
Below are several best practices to follow when implementing Live Streaming and assessing the need to obtain driver consent:
- Determine whether driver consent is required for Live Streaming. For example, is it:
- A condition of employment at the company of which all drivers are made aware at time of hire.
- A condition of employment at the company, and informed consent is required for all drivers.
- Not a condition of employment at the company, but the company will obtain informed consent from all drivers. Informed consent will be periodically affirmed annually.
- Define and document the specific purposes for which Live Streaming will be used. Some valid purposes include:
- High value cargo carriers
- Emergency (e.g., collision) investigation
- Driver training (new hire)
- Driver training (performance monitoring)
- Limit access to Live Streaming to only authorized company employees with a specific need for it (e.g., Safety Managers or Driver Managers).
- Place limitations on the duration of Live Streaming (e.g., implement a policy of no more than 15 minutes of Live Streaming per vehicle/device per month).
- Provide notice to drivers (e.g., place a sticker in the cab alerting drivers that Live Streaming may be enabled at any time).
I acknowledge that an assessment pertaining to driver consent for Live Streaming has been completed and Ramco Enterprises Lp (the company”) complies with all federal, state, and local regulations pertaining to it. When required, the drivers at the company have been advised of and given consent to the company's requirement to view activity inside of the vehicle, on-demand and at any time, in support of specific purposes, using camera systems that have been installed in the vehicle. This includes a view of the driver and passenger area of the cab while the vehicle is being operated.
